North Luwu Regency”, Thesis Concstitutional Law Study
Program Sharia Faculty Palopo State Islamic Institute.
Supervised by Muammar Arafat Yusmad and Nirwana Halide.
This thesis discusses research wich aims to find out the background expansion of
Sabbang District and to understand the political and legal process of expanding
the South Sabbang District area in North Luwu Regency. Type the research using
normative and sosiological juridical approaches. There are two data sources in
this research, primary and secondary. The data collection methods used were
interview observation and documentation. The result of the research show that the
background to the discourse on the expansion of South Sabbang began in 2000,
wich was carried out by isolatod communities deu of the long distansce traveled
to carry out activities in the sub-district capital. So that the community proposed
the formation of a sub-district. The new one is South Sabbang District consists of
three major stages, namely 1) community proposals, 2) when the proposals have
entered the regional legislation program (Prolegda), 3) Issueance of reginonal
regulations. Views of siyasah fiqh, expansion and population services is included
in the scope of dusturiyah fiqh, namely regarding leaders on the one hand and the
people on the other hand also the law of maslahah mursalah, because the aim of
expansion carried out of population services is to achieve the benefit and prevent
harm to the people. In Shout Sabbang District many benefits have achieved which
need to continue to be innovated to improve in order to archieve better benefits.
