dalam Perspektif Hukum Ekonomi Syraiah”. Skripsi Program
Studi Hukum Ekonomi Syariah Fakultas Syariah Institut Agama
Islam Negeri Palopo. Dibimbing oleh Muh. Darwis dan Agustan.
Skripsi ini membahas tentang sistem jual beli barang pesanan pada usaha meubel
Aditiya dalam perspektif hukum ekonomi syariah. Penelitian ini bertujuan: untuk
mendeskripsikan sistem jual beli barang pesanan pada usaha meubel Aditiya dan
untuk menganalisis perspektif hukum ekonomi syariah terhadap sistem jual beli
barang pesanan pada usaha meubel Aditiya. Jenis penelitian yang digunakan
adalah penelitian empiris dengan menggunakan pendekatan sosiologis. Teknik
pengumpulan data yang digunakan yaitu observasi, wawancara dan dokumentasi.
Hasil penelitian ini menujukkan bahwa: pertama, sistem jual beli barang pesanan
pada usaha meubel Aditiya, dimana terjadi ketidaksesuain barang pesanan
konsumen, maka pihak pemilik meubel harus lebih teliti dalam proses pembuatan
barang agar barang yang dipesan sesuai dengan keinginan konsumen. Mekanisme
pembayaran pada usaha meubel Aditiya dilakukan secara tunai ataupun
pembayaran uang muka sebesar 50% dari harga yang telah disepakati diawal.
Pengiriman barang dilakukan sesuai dengan kesepakatan pemilik meubel dengan
pihak konsumen serta waktu pembuatan barang dilakukan berdasarkan
kesepakatan kedua belah pihak. Kedua, perspektif hukum ekonomi syariah
terhadap sistem jual beli barang pesanan pada usaha meubel Aditiya, jika dilihat
dari akad istishna’ telah memenuhi rukun dan syarat akad istishna’. Akan tetapi,
secara keabsahannya tidak memenuhi syarat istishna’ dan tidak sejalan dengan
prinsip-prinsip hukum ekonomi syariah seperti prinsip kejelasan mengenai waktu
penyelesaian barang dan pengiriman barang sering mengalami keterlambatan dan
prinsip kejujuran mengenai kualitas barang yang diterima pelanggan tidak sesuai
dengan yang dijanjikan oleh pemilik meubel.

This thesis discusses the buying and selling system of ordered goods in the Aditiya
furniture business in the perspective of sharia economic law. This study aims: to
describe the buying and selling system of ordered goods at the Aditiya furniture
business and to analyze the perspective of sharia economic law on the buying and
selling system of ordered goods at the Aditiya furniture business. The type of
research used is empirical research using a sociological approach. The data
collection techniques used are observation, interviews and documentation. The
results of this study indicate that: first, the system of buying and selling ordered
goods in the Aditiya furniture business, where there is a mismatch of consumer
ordered goods, then the furniture owner must be more thorough in the process of
ordering goods so that the goods ordered are in accordance with the wishes of
consumers. The payment mechanism for the Aditiya furniture business is carried
out in cash or an advance payment of 50% of the agreed price at the beginning.
Delivery of goods is carried out in accordance with the agreement of the owner of
the furniture with the consumer and the time of making the goods is based on the
agreement of both parties. Second, the perspective of Islamic economic law on the
system of buying and selling ordered goods in the Aditiya furniture business,
when viewed from the istishna' contract, has fulfilled the pillars and conditions of
the istishna' contract. However, in terms of validity, it does not meet the
requirements of istishna' and is not in line with the principles of Islamic economic
law such as the principle of honesty.
