Permintaan Kembalinya Tanah Wakaf oleh Ahli Waris”. Skripsi Hukum
Ekonomi Syariah Institut Agama Islam Negeri Palopo. Dibimbing oleh
Muh. Darwis dan Nurul Adliyah.
Penelitian ini bertujuan untuk mengetahui permasalahan tanah wakaf yang
diminta kembali oleh ahli waris dengan perspektif hukum ekonomi syariah
sebagai aspek tinjauan hukum dalam memandang kondisi transaksi wakaf di
masyarakat. Penelitian ini mengangkat dua rumusan masalah sebagai subjek
penelitian yaitu: pertama, faktor-faktor apa yang menyebabkan permintaan
kembalinya tanah wakaf oleh ahli waris dan kedua, bagaimana permintaan
kembalinya tanah wakaf oleh ahli waris ditinjau dari aspek hukum ekonomi
syariah.
Penelitian ini menggunakan penelitian hukum normatif dengan metode analisis
deskriptif kualitatif. Adapun pendekatan penelitian ini menggunakan pendekatan
yuridis. Mengenai sumber data yang digunakan dalam penelitian ini diperoleh dari
data tertulis, dimana dalam mengumpulkan dan mendapatkan data dari tiga
sumber yaitu data primer (Al-Qur’an, Al-Hadits dan Perundang-undangan), data
sekunder (Doktrin hukum dan telaah pustaka), dan data tersier (Kamus umum,
kamus hukum dan ensiklopedia).
Hasil penelitian menunjukan faktor yang mempengaruhi terjadinya permintaan
kembali tanah wakaf oleh ahli waris bahwa pengelolaan tanah wakaf yang
dikelola dan diawasi oleh naẓir terkadang memicu sejumlah perkara di
masyarakat, antara lain naẓir terkadang menyalahi aturan dalam mengelola tanah
wakaf. Kurangnya dokumentasi tertulis yang memungkinkan ahli waris meminta
kembali tanah wakaf yang telah diwakafkan oleh wakif. Minimnya pemahaman
masyarakat terhadap pendaftaran tanah wakaf. Ahli waris tidak mengakui adanya
ikrar tanah wakaf yang telah diwakafkan oleh wakif. Dalam aspek hukum
ekonomi syariah tindakan meminta kembali tanah wakaf oleh ahli waris sama
halnya menyalahi prinsip dari ekonomi syariah salah satunya yaitu prinsip
ketuhanan (Ilahiah) dan tidak sesuai dengan aturan yang tertuang dalam kompilasi
hukum ekonomi syariah Pasal 721 “Suatu shadaqah tidak dapat ditarik kembali
jika sudah diserahkan dengan alasan apapun”.

Waqf Land By Heirs”. Islamic Economic Law Thesis Palopo Islamic

This study aims to determine the problem of waqf land that is request back by
heirs with the persvective of sharia economic law as an aspect of legal review in
viewing to the condition of waqf transactions in the community. This study takes
two problem formulations as research subjects namely: first, what are the factors
for requesting the return of waqf land by heirs and second, how is the requesting
the return of waqf land by heirs in terms of sharia economic law aspect.
This study uses normative legal research with a qualitative descriptive analysis
method. The research approach used in this study uses a juridical approach.
Regarding the sourceof the data used in this study, it was obtained from written
data, in wich to collect and obtain data from three sources, namely primary data
(Al-Qur’an, Al-Hadits and laws), secondary data (Legal doctrines and literature
review), and terteary data (common dictonaries, legal dictonaries and
encylopedias).
The result of the study show that the factors that influence the request for return of
waqf land by heirs are that the management of waqf land managed and supervised
by the naẓir sometimes triggers a number of cases in society, including the naẓir
sometimes violating the rules in managing waqf land. Lack of written
documentations that allows the heirs to ask back the waqf land that has been
donated by the wakif. The lack of public understanding of waqf land registration.
The heirs do not recognize the pledge of waqf land that has donated by the wakif.
In the aspect of sharia economic law, the act of taking back waqf land by heirs is
the same as violating sharia economic principles one of which is the divine
principle and is not in accordance with the rules contained in the complilation of
sharia economic law Article 721 “A shadaqah cannot be withdrawn if submitted
for any reason”.
