Abstract

NURUL RAHMAWATI, 2024. “A Review of Islamic Law on the Role of Land
Deed Making Officials in the Making of Sale and Purchase Deed in
Palopo City”. Thesis of Islamic Economic Law Study Program, Faculty
of Sharia, State Islamic Institute of Palopo. Supervised by Muammar
Arafat Yusmad and Muhammad Yassir Akbar Ramadhan
This study aims to find out and understand the "Role of Land Deed Officials in
Making Sale and Purchase Deeds reviewed from Islamic Law in Palopo City" and
also to find out and understand how to solve the obstacles or constraints of PPAT
in making sale and purchase deeds in Palopo City. The type of research used is
empirical research using a statutory approach. Research data or data sources
obtained through primary data come from interview scripts and secondary data
come from observations along with documentation and observations made. Data
analysis was carried out using descriptive methods and data reduction where
researchers focused on, simplified, summarized and displayed data to provide an
overview of how "The Role of Land Deed Officials in Making Sale and Purchase
Deeds reviewed from Islamic Law in Palopo City". The results of the study indicate
that PPAT plays a very important role in the interests of making sale and purchase
deeds and PPAT is required to resolve certificate problems or errors in personal
data to the relevant parties, then provide a preventive or preventive approach to the
community in order to provide facilities for understanding that making a sale and
purchase deed is not only made but must first be completed with a land certificate
that is free from problems of legality of identity and land identity. Therefore, in
terms of Islamic law, it is in accordance with applicable Islamic law, this is in line
with Q.S Al Baqarah verse 282 and Q.S An Nisa verse 59 as well as the provisions
of UUPA No. 5 of 1960 and PP No. 24 of 2016 concerning the position of PPAT.
